These Terms and Conditions may be updated by us from time to time without notice to you. We will post any changes to these Terms and Conditions on this page and we will also indicate at the top of this page the date that these Terms and Conditions were last revised.

By browsing and using www.peachyteaching.co.uk you are agreeing to comply with and be bound by the following Terms and Conditions of use, which govern the relationship between you and Peachy Teaching.

Your continued use of the service or the website after any such changes constitutes your acceptance of the new Terms and Conditions. If you do not agree to abide by these or any new Terms and Conditions, do not use or access (or continue to use or access) the service or the website. It is your responsibility to regularly check this page to determine if there have been changes to these Terms and Conditions and to review such changes.

You should print a copy of these Terms and Conditions for future reference.

Definitions

Billing date means the date you sign up to the Peachy Teaching Subscription, is the day we commence with your billing period of twelve (12) months. 

Content  means all material, content or products accessed, downloaded or purchased via our websites. This content includes text, images, sounds, videos, styles, animations, graphics, data, products, materials, services, links, technology, code, language, functions, software and applications or any other content made available on or through any Peachy Teaching-related site and any related Intellectual Property. 

Etiquette means a code of behaviour you must follow to ensure that Peachy Teaching remains a fun, safe environment for its members. You must ensure that your own behaviour is not offensive to others, as deemed by Peachy Teaching. Peachy Teaching has a zero-tolerance policy for bullying and offensive behaviour.

Intellectual Property means all related intellectual property rights including, without limitation: trade marks, copyrights, right to extract information from databases, design rights, privacy policies, and any related intellectual property rights (whether or not any of them are registered and including applications and the right to make applications for registration of any of them).

Member (and/or Subscriber) means you! The user who is subscribed to our Peachy Teaching Subscription, and is accessing and using any of the websites and/or Peachy Teaching Content. In doing so, you agree that you are responsible for maintaining the confidentiality of the password and account. You acknowledge that you are fully responsible for all activities that occur under your password or account.

Subscription means the Peachy Teaching Subscription that the Member has undertaken, where Peachy Teaching supplies the Member the Content as agreed upon, by subscription and license. You acknowledge that the Peachy Teaching Subscription lasts for a period of twelve (12) months. Please note, following the end of the Subscription period, your access to our resource portal will lapse. If you wish to continue your access to our resource portal, and renew your Subscription with Peachy Teaching, you will be required to opt-in to a new subscription.

User – means any person who wishes to access the Peachy Teaching site in accordance with the Terms and Conditions and any other relevant policy.

 

1. About Us

1.1 Peachy Teaching is the trading name of Peachy Teaching Limited (11322471) Orchard House, Bellamour Way, Colton, Rugeley, England, WS15 3LN. 

1.2 We are an online subscription-based hub dedicated to creating premium quality, printable teaching resources – we call this the ‘Service’. Our resources are primarily distributed through www.peachyteaching.co.uk and/or www.peachyteaching.com. 

2. Subscriber Service

2.1 To gain access to our platform of resources, you must pay the Subscription Fee to Peachy Teaching.

2.2 Upon payment of the Subscription Fee, Peachy Teaching grants a non-exclusive, non-transferable Licence to the Subscriber to use the Resources for the Term in accordance with the Permitted Uses and as otherwise set out in this Licence. For clarity purposes, payment of one Subscription Fee with Peachy Teaching grants access to one user only. 

2.3 We reserve the right to change our pricing and/or availability in respect to any of our services in this clause for any reason and without notice.

2.4 Peachy Teaching is not responsible for non-delivery or technical limitations of the user for any reason in respect of any of the services in this clause. You are strongly advised to read our FAQ page. 

3. Member Accounts

3.1 There are parts of the Peachy Teaching websites that may require you to register and provide information about yourself. By doing so, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the relevant registration form and (b) maintain and promptly update any such identifying data to keep it true, accurate, current and complete, via email. We shall not be liable for any loss suffered by your none compliance with this provision. 

3.2 Peachy Teaching will endeavour to protect all personal information collected through the Website in accordance with strict data protection standards. Your privacy is incredibly important to us. You can read more about it in our Privacy Policy.

3.3 Your account is strictly for personal use only and you may not use your account to download and print for anyone else or share your login details. 

3.4 Your member account is subject to an acceptable use policy (as detailed in section 21) and your user accounts are monitored.

3.5 Automatic renewel is set up on solo subscriptions as of 5th July 2023. If you wish to switch off auto-renewel you may do this in your member dashboard. 

3.6 Requesting to cancel your account can be done by emailing support@peachyteaching.co.uk. 

4. Username and Password 

4.1 The registration process on the Peachy Teaching site will involve you giving a password and account.

4.2 You are responsible for maintaining the confidentiality of this password and account, and you are fully responsible for all activities that occur under your password or account. 

4.3 You must take all reasonable steps to keep login details confidential.

4.4 You must not share your login details with anyone.

4.5 You must let Peachy Teaching know of any breach of security such as any unauthorised use of your login details.

4.6 You should change login details immediately if you believe that such details are known to someone else.

4.7 You are responsible for keeping your login details secure and confidential. If you believe that your details are not secure, then you need to get into contact with Peachy Teaching as soon as possible.

4.8 Peachy Teaching cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

5. Withdrawal of Access

5.1 Peachy Teaching reserves the right to suspend or withdraw your login access at any time without notice and at its sole discretion pending investigation where it has reason to believe that such member details have been discovered and/or used by any person or organisation other than an authorised user of Peachy Teaching’s Subscription Services. For completeness, an authorised user of Peachy Teaching’s Subscription Services is defined as a member and/or Subscriber. This is a person who has registered for the Subscription to use and agrees to protect the confidentiality of their login details.

5.2 Peachy Teaching may withdraw login access by giving notice to you if you are in breach of these Terms and Conditions and in such case Peachy Teaching is not obliged to refund you any fees for Subscription Services.

5.3 You agree that Peachy Teaching may, in its sole discretion and without prior notice, terminate your access to your Subscription and Content and/or block your future access to the Peachy Teaching websites, Subscriptions and Contents, if we determine that you have violated this agreement via breach of Etiquette.

5.4 Where there is a breach of these Terms and Conditions, the right described in this paragraph are not Peachy Teachings only causes of action and we may take any other action we reasonably deem appropriate in connection with such a breach. 

6. Unaffiliated Communities

6.1 You acknowledge that Peachy Teaching is not to be held liable for any unaffiliated communities and forums created via social media platforms (including but not limited to Facebook, Instagram and TikTok) and/or any groups that may claim affiliation with Peachy Teaching.

6.2 You agree that Peachy Teaching is not liable for any business or exchange that may occur with any of these groups, communities or forums.

6.3 Additionally, Peachy Teaching is not responsible for any breaches of Etiquette that may occur in these unaffiliated communities.

7. Links to other Websites or resources

7.1 Peachy Teaching or third parties may provide links to other websites or resources. As Peachy Teaching has no control over these sites or resources, you acknowledge and agree that Peachy Teaching is not resposible for the availibility of such external sites or resources and does not endourse and is not resposible or liable for any content, advertising, products or other materials on or available on such sites. 

7.2 You acknowledge and agree that Peachy Teaching shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alledged to be caused by or in connection with use of or reliance on any such content, good or services available on or through any such site or resource. 

8. Use of Peachy Teaching Resources

8.1 All articles, information and other materials presented by Peachy Teaching on or through its websites are subject to copyright, trademark rights and/or other intellectual property rights.

8.2 You acknowledge that you must not reproduce, redistribute or extract any of the content in the Subscription, including providing links to or otherwise communicating or making available to third parties any part of the content produced by Peachy Teaching, without written consent. You acknowledge that these resources are for your sole personal use. 

8.3 By making use of Peachy Teaching’s content and website, you are agreeing to comply with this prohibition and that any breach thereof is likely to result in legal proceedings being issued against you.

8.4 You agree that by use of these resources, you will not redistribute resources and you understand that any resources you download are for your personal use only.

9. Errors in resources

9.1 Neither Peachy Teaching nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose.

9.2 You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

10. Duty of care

10.1 You access the Peachy Teaching Websites and resources at your own risk and are responsible for compliance with the laws of their jurisdiction in addition to those contained in these Terms of Use. Peachy Teaching does not assume a duty of care to the Users.

10.2 You acknowledge that your subscription to our services are meant for informational purposes only and is not intended for specific commercial, financial, or other professional advice.

10.3 Please ensure you take the time to read the description of our offering and the subscription as the onus lies with you to ensure that the resources are content-appropriate, relevant and to professional standards when used in an educational setting.

11. Modifications

11.1 Peachy Teaching reserves the right to amend, modify and remove any content available in the Subscription Service at any time by amending its resources on its websites.

11.2 Users are responsible for regularly reviewing information published online to obtain timely notice of such revisions.

11.3 Users continued use of the websites after changes are published constitutes acceptance of these published revisions.

11.4 Peachy Teaching may update and change its websites from time to time to reflect changes to our products, our users’ needs and our business priorities.

12. User generated content

12.1 You are welcome to use an image or two (unaltered) from the Peachy Teaching Instagram and TikTok Social media pages so long as it is credited and accompanied by a link back to us.

12.2 Using our photos in bulk, even with a credit, is prohibited owing to the digital nature of our products.

12.3 Please contact us for express written permission if you would like to use more than a few photos.

13. Indemnity

13.1 If you breach the Peachy Teaching Terms and Conditions, you acknowledge that you agree to indemnify us for any loss that we may suffer or any costs that may be incurred from your breach.

13.2 Any failure by us to exercise any right, power or remedy under these Terms and Conditions shall not operate as a waiver of our rights.

13.3 This indemnity includes both any liability to third parties, and other costs and losses incurred by Peachy Teaching.

14. Special warning for international use

14.1 The website is designed to be compliant with the applicable laws and refulations of England and Wales. Due to the global naure of the internet, users from all over the world will have access to the website, however if you are a resident in a country outside of the UK you use the website at your own risk. 

15. Modifications to service

15.1 Peachy Teaching reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the content and/or subscription (or any part thereof) with or without notice.

15.2 You agree that Peachy Teaching shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Peachy Teaching subscription.

16. Dealing with advertisers and other suppliers

16.1 Your dealings with advertisers, merchants and any other third party found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. 

16.2 You agree, with reference to any applicable law, that Peachy Teaching shall not be responsible or liable for any loss or damage of any kind incurred as the result of any such dealings or as the result of the presence of such advertisers and merchants on the Peachy Teaching subscription, and/or the Website.

16.3 You agree, that any orders placed by you on, and any product specifications and product availability appearing on, the service or the website are subject to confirmation by, and are supplied subject to the terms and conditions of business of, the relevant merchant. 

17. Disclaimers

17.1 You expressly acknowledge and agree that:

17.1.1The content of the pages of this Website is for your general information and use only. It is subject to change without notice.

17.1.2 Your use of the Peachy Teaching Subscription is at your sole risk. Peachy Teaching has made every effort to ensure that the content made available through the subscription is accurate and up-to-date and correct at the time of publication. However, Peachy Teaching content and the subscription provided on an ‘as is’ and ‘as available’ basis. We do not guarantee the accuracy, timeliness, completeness or fitness for the purpose of the content provided on the website or through the service or that the use of the website will be uninterrupted, virus free or error free. No responsibility is accepted by or on behalf of Peachy Teaching for any errors, omissions or inaccurate information on or through the website and/or subscription.

17.1.3 Unauthorised use of this Website may give rise to a claim for damages and/or be a criminal offence.

17.1.4 From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that Peachy Teaching endorses the website(s) and Peachy Teaching has no responsibility for the content of the linked website(s).

17.1.5 The Content on the Website and made available through the subscription is for general information only and is not intended to, nor does it, constitute legal or other professional advice or services or a recommendation to purchase any product or service upon which a specific decision should be made. You acknowledge that any use of Peachy Teaching Content is not a substitute for proper professional advice.

17.1.6 Peachy Teaching is not responsible for how the content and/or subscription is used, is interpreted or what reliance is placed on it. We do not accept any responsibility for the results of any action taken based on the information provided on the website or available through the subscription. It shall be your own responsibility to ensure that any products, services or information available meet your specific requirements.

17.1.7 Any material downloaded or otherwise obtained using the Peachy Teaching subscription is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

17.1.8 No advice or information, whether oral or written, obtained by you from Peachy Teaching shall create any warrenty or other obligation not expressly stated in these Terms and Conditions. 

18. Availability of the Website

18.1 You acknowledge that Peachy Teaching cannot guarantee that the website will operate continuously without interruptions or be error free and Peachy Teaching therefore accepts no liability for its unavailability.

 You must not attempt to interfere with the proper working of the Peachy Teaching website and you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, Website, router or any other internet connection device.

19. Limitations of Liability

19.1 Except as provided in this clause, and despite any implication arising from any other clause, Peachy Teaching will not be liable to the subscriber or any person claiming under the subscriber in contract or in tort (including negligence) or under statute for or in respect of any direct loss, indirect loss or consequential Loss, damage, expense or injury suffered by the Subscriber or any other person, arising out of or in relation to the resources or to this licence, its performance, any delay in its performance or its non-performance (including as a result of negligence or default), or any error in information supplied to the subscriber before, during or after expiry of the term.

19.2 You expressly acknowledge and agree that Peachy Teaching shall not be liable for any indirect, incidental, special, consequential or exemplary damages, nor for direct or indirect loss of profits revenue, business, anticipated savings, goodwill, opportunity, reputation, business interruption, use, data or intangible losses even if Peachy Teaching has been advised of the possibility of such damage.

19.3 Nothing in these Terms and Conditions shall affect the statutory rights of any consumer or exclude or restrict any liability for fraud or for death or personal injury arising from the negligence of Peachy Teaching. 

20. Terms of Your Subscription

20.1 Your subscription to Peachy Teaching is subject to these Terms and Conditions in every aspect.

20.2 These additional conditions shall apply to this service:

20.2.1 In accordance with the general Terms and Conditions, your username and password will not be shared with anyone.

20.2.2 In accordance with our Copyright Terms, you will not redistribute resources, sell (or attempt to sell), print multiple copies or use the content for public display and you understand that any resources you download are for your personal use only. 

20.2.3 You agree that Peachy Teaching content is subject to these Terms and Conditions. Contingent on that agreement, you may display this content on a computer screen or mobile device, electronic or interactive whiteboard, print on paper and store such pages in electronic form for your own personal, educational, non-commercial purposes.

20.2.4 Peachy Teaching’s status as the authors of content must always be acknowledged.

20.2.5 If you are operating as a private tutor for commercial gain, then you may use the content directly in that capacity.

20.2.6 You agree to abide by the Peachy Teaching Copyright Terms. You may not remove the copyright or trademark notice from any copies of Content made under the Subscription.

20.2.7 You agree that a breach of any of the general Terms and Conditions will lead to the account being immediately suspended. It is at Peachy Teaching’s absolute discretion as to whether the account will be reinstated.

20.2.8 You agree that we will monitor your usage of the website to allow us to determine whether a violation has, or is, occurring.

20.2.9 Due to the digital nature of our products, we DO NOT offer any refunds or returns for the subscription.

21. Acceptable Use Policy

21.1 Peachy Teaching considers that no user would reasonably need to download more than 100 resources each month and accounts exceeding this download level are subject to review.

22. Intellectual property

22.1 Any material or information downloaded from this website is subject to Copyright Terms. You may not modify, copy, reproduce, republish, upload, post, transmit or distribute, by any means or in any manner, any material or information downloaded from or through this website without prior written authorisation from a director of Peachy Teaching.

23. Governing Law

23.1 The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us. 

23.2 Your use of this website and any dispute arising out of such use of the website is subject to the laws of England and Wales and you hereby consent to this jurisdiction.

24. Subscription Offers and Competitions

24.1 All competitions or offers coordinated by Peachy Teaching on official social media accounts or marketing emails will make clear what any offer includes, who is able to participate, how to participate/redeem and when said competitions/promotion/voucher begins and ends. Any entries that do not meet these requirements will not be entered in to any promotion.

24.2 Promotions by our staff will give specific restrictions and conditions of entry for each offer in the launching of any competition. The staff operating the promotions will be available to answer questions and clarify the terms of entry for any potential entries.

24.3 Any given conditions of entry will be made clear before or at the time of entry for prize draws, discount opportunities or offer codes. These conditions will remain accessible through the period of the promotion.

24.4 All discount codes will be valid for one subscription year ONLY and full price of £29.99 will be billed each year after. 

25. Privacy Policy

25.1. You consent to us collecting and using technical information and data about the device on which you download and use the Digital Content and about any associated hardware and software used by you so that we may improve our service to you and ascertain whether you are in breach of the terms of the Terms and Conditions

25.2. We shall be entitled to process your data in accordance with the terms of our Privacy Policy. Please view this document for further information. All information provided by you will be treated securely and in accordance with the Data Protection Act 1998 (as amended).

25.3. We do not store credit card details nor do we share customer details with any 3rd parties. These are encrypted via PayPal or Stripe.
